Senior BJP leader Subramanian Swamy has written a letter to Lieutenant Governor of Delhi Najeeb Jung seeking sanction to prosecute Delhi Chief Minister Arvind Kejriwal and Deputy Chief Minister Manish Sisodia. Swamy has accused Kejriwal and Sisodia of committing crimes like corruption, bribery, cheating and breach of trust.

Swamy, who is a member of the Bharatiya Janata Party’s National Executive, told The Sunday Guardian: “Arvind Kejriwal and Manish Sisodia have committed crimes under relevant sections of the Prevention of Corruption Act and the Indian Penal Code. They have favoured companies that were listed as tax defaulters just before the Aam Aadmi Party first came to power. They have taken a bribe of Rs 2 crore from one SKN Associates. Prima facie, they have committed crimes like bribery, breach of trust and cheating.”

“Under Section 19 of the Prevention of Corruption Act, I have to seek a ‘No Objection Certificate’ from the Lieutenant Governor of Delhi Najeeb Jung for prosecuting Arvind Kejriwal and Manish Sisodia. That is the reason I have written to the LG,” Swamy said, adding  that Kejriwal and Sisodia sought donations for personal ends from SKN Associates. “The Constitution of the Aam Aadmi Party states that for taking any donation larger than Rs 1 crore, prior permission has to be taken from the Political Affairs Committee. That is the objection that the donation received is personal to them as these donations were not informed to the PAC,” Swamy said.

AAP, on the other hand, has refused to comment on the matter, saying the BJP itself does not give importance to Swamy. “(Swamy) has done a PhD in telling lies. All his attempts to malign several important persons have proved to be futile. His own party has refused to give him any important positions. It is better we make no statement on him,” AAP leader Somnath Bharti said.

Sources in AAP claim that this is a vendetta move by Swamy as the Delhi government had in the past sought sanctions for prosecuting Swamy for writing an allegedly “inflammatory piece in a Mumbai daily” in 2011. They claimed that Jung had, after examining the alleged article, found Swamy guilty of committing an act of “gross impropriety to break the secular fabric of Indian culture”.

Commenting on AAP’s allegation, Swamy said: “Any action regarding AAP’s allegations must come from the police. If they do not have any issue with any article that I wrote, and it has been quite some time, what issue do AAP leaders have?”

Swamy alleged that Kejriwal and Sisodia, after coming to power, started “milking defaulters”. “Officers inform me that instead of the duo heeding their constitutional duty to collect taxes for the exchequer, Kejriwal and Sisodia started taking money from these defaulters.”

According to Swamy’s letter, SKN Associates has four subsidiary companies—Goldmine Buildcon Private Limited, Skyling Metals and Alloy Private Limited, Infolance Software Solutions Limited, Sunvision Agencies Private Limited—who paid Rs 50 lakh each to the AAP on the same day, 5 April 2014.

“All these non-operative companies with no notable turnovers or profits paid Rs 2 crore in total at the same time (at midnight) to AAP,” Swamy said. “This is, prima facie, a misuse of office and misappropriation of public money and receiving quid pro quo in lieu of favour by Kejriwal and Sisodia for VAT defaulters,” Swamy said in his letter to the LG.
